LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Frank De Baere SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of profits, business interruption, or personal injury arising from use of this software, even if advised of the possibility of such damages.

Maximum liability is limited to €10 (ten euros).

GOVERNING LAW & JURISDICTION:

Belgian Law: This agreement is governed by the laws of Belgium and European Union regulations, without regard to conflict of law provisions.

Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Flanders, Belgium.

ENFORCEMENT & DAMAGES:

Unauthorized use will result in immediate legal action. The copyright holder reserves the right to seek:

  • Injunctive relief (immediate cease and desist)
  • Statutory damages under Belgian/EU copyright law
  • Actual damages (minimum €10,000 per violation or proven damages, whichever is greater)
  • Reimbursement of attorney fees and legal costs
  • Criminal prosecution where applicable

SEVERABILITY & ENTIRE AGREEMENT:

If any provision is found unenforceable, remaining provisions remain in full effect. This constitutes the entire agreement regarding use of this software.

UPDATES & MODIFICATIONS:

Frank De Baere reserves the right to modify these terms at any time. Continued use after changes constitutes acceptance.
